Are Children at Risk Due to Dangerous Baby Swings and Rockers?
There are numerous different types of consumer products that may present a risk of injury to people. While adults may be able to recognize the potential dangers of a product, children often cannot, and they may therefore be seriously injured due to defective baby products, toys, or other items. Recently, millions of defective baby swings and rockers were recalled due to safety issues that could potentially harm infants. Families of children who are injured by dangerous products may be able to pursue compensation from a manufacturer through a product liability lawsuit.
Recall of Baby Products Manufactured by 4moms
On August 15, 2022, the Consumer Products Safety Commission announced a recall of baby swings and rockers that are in wide use throughout the United States and Canada. These items, sold at retail stores and online, were found to cause danger to infants due to the straps used on these products.
When unused, the straps dangled below the seats of swings and rockers. This presented a risk that a child who was crawling on the floor near a swing or rocker could become entangled in the dangling straps. The CPSC received reports that one child died from asphyxiation after becoming entangled, and another suffered serious bruising but was rescued by an adult in time to prevent death. As a result of these safety concerns, the company is recalling around two million swings and 220,000 rockers. The company is also providing consumers with free fasteners that can be used to secure straps when a swing or rocker is not being used. Consumers are also being advised to stop using the defective products and place them in an area where they do not present a danger to crawling infants.
Pursuing Compensation for Defective Baby Products
Families of infants who have been injured by defective baby products may be able to take steps to hold negligent companies responsible for the harm caused by these products. When a family files a product liability lawsuit, they may be able to recover compensation for medical expenses, pain and suffering, and other damages.
Product liability lawsuits may be based on defective product designs, errors in the manufacturing process that made products unsafe, or a product manufacturer's failure to provide warnings about the potential risks of injuries when using a product. In cases related to the recalled baby swings and rockers, victims may be able to seek compensation based on design defects and failure to warn people about the risks of injury to crawling infants.
